Duly-licensed Practitioner files your annual New York City Motor Vehicle Tax (MVT). Tax period runs June 1 to May 31st. Vehicles Subject to MVT:
1) COMMERCIAL MOTOR VEHICLES: Any truck, tractor-trailer or semi-trailer, auto truck or light delivery car, traction engine, road roller, tractor crane, truck crane, power shovel, road building machine, snow plow, road sweeper, sand spreader, well driller or well servicing rig and any earth moving equipment as defined in the Vehicle and Traffic Law. Also included are pick-up and panel trucks, fork lifts (if operated on public streets) and camper trucks as well as station wagons requiring commercial registration. A commercial motor vehicle is taxable whether or not it is used for business purposes. The tax applies to any vehicle described above provided that such motor vehicle is used principally in New York City or used principally in connection with a business carried on in New York City.
A commercial motor vehicle is used principally in the City of New York if most of its mileage (50% or more) during the year is within the City regardless of whether business of the owner or operator is conducted within the City of New York. A commercial motor vehicle used principally in connection with a business carried within the City is subject to tax regardless of the mileage with or without the City of New York.
2) MOTOR VEHICLE FOR THE TRANSPORTATION OF PASSENGERS:
a) any motor vehicle licensed as a taxicab or a livery which carries passengers for compensation whether the compensation is based on mileage, trip, time consumed or any other basis; and
b) any omnibus except those operating under a franchise or a contract with the Port of New York Authority and that pay a percentage of gross earnings or receipts to such Authority or the City or omnibuses used exclusively in interstate commerce.
The tax applies to any motor vehicle described in (a) or (b) provided that such vehicle is used regularly in New York City. Such vehicle deemed to be used regularly in the City when it is used in the City thirty (30) or more different days during the tax year.
Vehicles NOT Subject to MVT:
*Commercial motor vehicle NOT used principally in the city and NOT used principally in connection with a business carried on in the City
*Motor vehicles for transportation of passengers NOT used regularly in the City
*Motor vehicle used exclusively for transportation of persons in connection with funerals
*Motor vehicle used principally for the transportation of children to and from schools or to and from day camps operated by non-profit organizations described in Section 11-803 subdivision 4 of the Administrative Code
*The motor vehicle is owned, operated or leased for the exclusive use by:
a) Any nonprofit organization which is organized and operated exclusively for religious, charitable or educational purposes or for the prevention of cruelty to children or animals;
b) Dealer in new or used motor vehicles where the use of the vehicle is confined solely to demonstrate to prospective customers or to delivery by or to the dealer and the vehicle bears dealer's license plates;
c) Foreign nation or representative of a foreign nation and is exempt from payment of a motor vehicle registration fee under the New York State Vehicle and Traffic Law;
d) New York State or any public corporation, improvement district or other political subdivision of the State;
e) The United Nations or other worldwide international organization of which the United States is a member; or
f) the United States of America.
You may file your MVT through this site ONLY if your vehicle is...
*a medallion taxicab;
*a non-passenger commercial motor vehicles with a registration maximum gross weight in excess of 10,000 lbs.;
*a non-passenger commercial motor vehicles with a registration maximum gross weight of 10,000 lbs. or less that are registered outside of New York City; or
*a motor vehicle used for the transportation of passengers that are registered outside of New York City but are used regularly within the City of New York.
